A goal of the Department is the safeguarding, storage and proper disposal of all property coming into its custody.

The Department strives to maintain property in the same condition as received and to preserve the evidentiary integrity of property that is contraband or held for presentation in court.

Every reasonable effort will be made to return the property to its rightful owner.

For inquiries about property release, please provide Name, ID # and SJPD case number.

Recovering Property Booked for Safekeeping

  • Property booked for safekeeping is release by appointment only. 
  • Please call (408) 277-4268 to schedule an appointment. 
  • Appointments are scheduled Tues - Thurs 7:30 AM - 11:30 AM, and 1:00 PM - 02:30 PM
  • Owner must provide valid photo ID and SJPD case number
  • Safekeeping property will be held for 90 days.

Recovering Property Booked as Evidence

  • Property booked in as evidence, must be cleared for release by the assigned investigator/Unit.
  • Property owners must contact Investigator for the property clearance process to begin.
  • Investigator will make contact with the property owner when the property is no longer needed for investigative purposes and is cleared for release.

Firearms Recovery

If the San José Police Department is currently holding a firearm that has been seized or voluntarily surrendered from your possession; California state law requires that you obtain eligibility clearance prior to the release of any firearm, ammunition, or ammunition feeding device to your custody and proof of ownership must be established. The responsibility for requesting and receiving this clearance is solely that of the legal owner.

Please Note:

If you have been convicted or are the subject to on-going prosecution of certain crimes, or are the subject of a restraining order, or have been the subject of mental health holds/commitments, you may be ineligible to possess firearms. Other restrictions precluding you from obtaining your firearm(s) may also apply.


Pursuant to Penal Code section 33850:

Any person who claims title to a firearm, ammunition and/or ammunition feeding device, that is in the custody or control of a court or law enforcement agency, and who wishes to have these items returned, is required to submit a Law Enforcement Release Application (LER) with the California Department of Justice Bureau of Firearms.

Applicants must electronically submit a
Law Enforcement Release (LER) application via the
California Firearms Application Reporting System (CFARS).

LER does not establish ownership; complete a Firearm Ownership Report to establish ownership if applicable.

You must complete the LER application, pay the required DOJ application fees, and receive approval before any firearms will be released to you.

Once you receive written approval from the Department of Justice, you must contact the department to make arrangements to forward your written approval for review. 

IF YOU DO NOT OBTAIN DEPARTMENT OF JUSTICE APPROVAL AND FORWARD THE APPROVAL TO THE INVESTIGATOR WITHIN 180 DAYS OF THE DATE OF THIS NOTICE, YOU WILL FORFEIT YOUR RIGHT TO CLAIM YOUR FIREARM(S).


If you do not desire the release of your firearm(s), no further action is required.
